Dan is focused on advising clients in connection with corporate restructurings, bankruptcies, and other insolvency matters with a particular emphasis on insolvency-related litigation.
Based in Wilmington, he mainly practices before the United States Bankruptcy Court for the District of Delaware, but also before state and federal courts in other jurisdictions. Dan's experience includes representing clients in a broad range of industries, including biotechnology and medical devices, retail and restaurants, manufacturing, transportation, energy, healthcare, institutional lenders, and financial services.
In bankruptcy court, Dan represents corporate debtors, official committees, debtor-in-possession financers, secured and unsecured creditors, asset purchasers, officers and directors, and other major stakeholders. Specifically, prior to joining Benesch, he recently represented a long-term equity investor in cannabis and legal hemp-related entities as lead debtor's counsel, securing court approval of a global settlement that resolved the litigation that led to the company's bankruptcy and confirming a plan of reorganization that paid creditors in full and preserved the existing equity interests in the debtor. In addition to his restructuring practice, Dan is an experienced litigator who has practiced in state and federal courts in a variety of jurisdictions in cases involving issues of corporate law and distressed commercial situations.
Dan earned his J.D. from Villanova University Widger School of Law in 2012, where he was the recipient of the Dorothy Day Award for Pro Bono Service. He graduated from the University of Colorado at Boulder in 2008 with a B.A. in History.
He is admitted to practice law in Delaware, New Jersey, Pennsylvania, and is a member of the Delaware State Bar Association, the American Bankruptcy Institute, and the Delaware Bankruptcy Inn of Court. Dan was honored by Delaware Today as a top lawyer in bankruptcy in both 2021 and 2022.
