Managing labor and employment issues continues to challenge all employers. Over the past 12 months federal agencies have been aggressively proposing and, in several cases, implementing new regulations. The EEOC has implemented controversial “guidance” regarding the use of background checks, OSHA has launched several new initiatives and OFCCP has essentially implemented the Paycheck Fairness Act for federal contractors. The coming year promises more of the same. The Department of Labor appears poised to implement its “right to know” initiative which will require employers to explain the basis for classifying employees as exempt under wage/hour laws, and the NLRB is continuing to expand its oversight of non-union workplaces. Over-shadowing all these changes is the uncertainty employers face in connection with the implementation of the Affordable Care Act (Obamacare).
