Jacob has extensive experience representing lenders, creditors, and debtors in bankruptcy and workout situations. That experience includes chapter 11 and 7 bankruptcies, UCC foreclosure actions, assignments for the benefit of creditors, and distressed debt sales.
He has served as lead attorney on several cases, successfully guiding clients through the entire bankruptcy process and related litigation matters. These matters include:
- Unlocked $10+ million in potential contribution funds for a client facing mass-tort lawsuits by challenging an injunction that was protecting jointly liable third-parties.
- Negotiated and drafted restructuring support agreement that settled claims of over $20 million, providing meaningful recovery for client and a consensual chapter 11 plan confirmation process that fully exculpates client.
- Helped middle-market transportation/logistics company achieve full rehabilitation by delaying foreclosure by secured lenders until company could close refinancing transaction.
- Through mediation, settled multi-million dollar preference litigation for 50% of client’s maximum settlement amount.
- While representing a secured lender syndicate at a bankruptcy auction, designed auction procedures and script that led to a final bid worth 150% of stalking horse bid and full recovery for client.
- Primary drafter of motion to dismiss and supporting briefs in $450MM equitable subordination case, leading to a positive (no subordination and no payments by client) settlement.
Jacob previously served as law clerk to Judge Eugene Wedoff (Ret., Bankr. N.D. Ill.). He focuses his pro bono work on helping fellow Chicagoans expunge/seal past criminal records and navigate the Deferred Action for Childhood Arrivals (DACA/Dreamers) application process.
